Experience

Barry joined the firm in 2007. Prior to joining the firm, Barry founded and managed a law firm in Fairfax, Virginia. Prior to that, Barry was a partner at a Washington, D.C. intellectual property law firm where he practiced in the intellectual property chemical practice group for over twenty-two years. Barry also served as a Patent Examiner for four years in the analytical, chemical reactor, refrigeration, and single crystal arts at the U.S. Patent & Trademark Office.

Practice Areas

Barry focuses his practice in chemical, food, pharmaceutical, and polymer technologies and has extensive experience in many aspects of intellectual property law. Significant experience includes: 1) assessing the patentability of inventions, 2) drafting and prosecuting patent applications around the world, 3) drafting and negotiating technology transfer agreements and confidentiality agreements, 4) conducting intellectual property due diligence investigations in connection with sales of businesses and product lines involving ascertaining the patent estate owned by the business and the product lines covered by the patents, and preparing and recording assignments relating to the patent estate, 5) preparing infringement and validity opinions with emphasis on counseling clients to enable the client to design around and avoid infringement of intellectual property rights of others, and 6) conducting interference disputes before the United States Patent and Trademark Office.

Another aspect of Barry’s intellectual property practice involves assessing the registerability of trademarks, drafting and prosecuting trademark applications, drafting and negotiating trademark transfer agreements, preparing cease and desist letters and negotiating settlements relating to trademark infringement, and recording assignments relating to trademark transfers and copyright transfers.
