In Schwarz Pharma, Inc. et al v. Paddock Laboratories, Inc., Civil Action No. 0:05-cv-832 (D. Minn 2006), Judge Ann D. Montgomery granted Paddock Laboratories Inc.'s motion for summary judgment of non-infringement in a patent infringement suit relating to Paddock’s generic version of the anti-hypertensive drug UNIVASC®. The Court ruled against plaintiffs Warner-Lambert and Schwarz Pharma, finding Paddock’s Abbreviated New Drug Application (ANDA) for Moexipril Hydrocholoride does not infringe U.S. Patent No. 4,743,450, listed in the Orange Book as covering UNIVASC® and other ACE inhibitor formulations.

The Court also upheld sanctions against Schwarz Pharma for violating the protective order. A copy of the Memorandum Opinion And Order is available here.
