Trademark Practice Group

The firm's Trademark and Copyright Group guides, counsels and represents clients in all aspects of intellectual property law which impact the marketing and branding objectives of its clients, including large established multi-national companies as well as start-ups, both foreign and domestic.

The Group's focus takes a multi-faceted and broad approach to protecting intellectual property rights, taking into consideration not only issues specific to trademark and copyright, but also trade dress and product design, design patent and business method considerations, and trade secrets, as well as other aspects of protecting intellectual property crossing over and into the patent arena.

The Group is comprised of multi-lingual attorneys, including a former U.S. trademark examiner, who are experienced in licensing, prosecution and litigation. Specific areas of the Group's experience include issues and strategies faced by overseas companies interested in using and registering new or established foreign trademarks in the United States; U.S. prosecution practices regarding trademarks used in association with scientific, optical and communications goods, pharmaceuticals, cosmetics, and related services; as well as traditional areas of trademark issue evaluation, opinions (including opinions regarding issues of infringement, scope, validity and enforceability) and licensing.

The Group has over fifteen years of experience in enforcing and defending its client's intellectual property rights in all areas of inter partes proceedings, including opposition and cancellation proceedings before the Trademark Trial and Appeal Board, as well as litigation in U.S. District Courts. In addition, members of the Group have prepared seminar presentations for practitioners overseas and domestically, most recently lecturing on the topic of U.S. Trademark prosecution practice for the Forum Institute in Munich at the German Patent Bureau, and presenting a seminar to members of the Association of Patent Law Firms on the topic of the U.S. trademark practice changes under the Madrid Protocol. Periodically, the Group prepares and distributes its own newsletter regarding current topics of interest in the trademark and copyright arena, with particular emphasis on trademarks. These newsletters are available at no charge, and, presently feature reviews on the practical considerations arising from the Madrid Protocol and recent U.S. Patent and Trademark Office Notices pertaining thereto.
